“In India SC has already declared privacy as a fundamental right so even an individual now can approach HC or SC if his data is compromised. The company maintaining the data in US but running any business in India will have to face consequences like paying compensation or criminal action while the Indian company will have limited or no recourse to the country and company where datacentre and data is actually located.”
