Controversy on Instagram Over "Kiss Challenge" Video With Minor invoking POCSO and IT Act
Instagram has faced backlash after a contentious video featuring a mother and her son engaging in the 'Kiss Challenge' was uploaded on the social media site. A lawsuit has been filed under the Information Technology (IT) Act and the Protection of Children from Sexual Offences (POCSO) Act in response to this occurrence, which happened in South Dinajpur, West Bengal. Following the video's viral success and the ensuing severe concerns it raised regarding the safety and privacy of minors on the internet, the National Commission for Protection of Child Rights (NCPCR) took action against the prominent social media company.
The ‘Kiss Challenge’ has been gaining traction on Instagram. It typically involves users posting videos of themselves kissing others, which has sparked widespread participation on the platform. However, this particular video has attracted legal attention due to the involvement of a minor, leading authorities to scrutinize the content under child protection laws.
After examining the content, the NCPCR determined that the film contravenes certain POCSO Act provisions aimed at shielding children from sexual offences. As a result, official notice has been sent to Instagram and its parent firm Meta; however, they have not yet addressed the accusations.
